Terms & Rules – Nirmaan ML Research Forum

By accessing or using Nirmaan ("Forum", "Service", "we", "us", "our"), you agree to be bound by these Terms & Rules. If you do not agree, do not use the Forum.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use this Forum. By using the Forum, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

2. User‑Generated Content License

All content posted on the Forum, including text, code, images, links, attachments and files ("User Content"), is the sole responsibility of the person who posted it. You retain ownership of your User Content but grant us a worldwide, non‑exclusive, royalty‑free, perpetual, irrevocable license to host, display, modify, distribute, and use your User Content as necessary to operate, promote, and improve the Forum.

3. Prohibited Content & Conduct

You agree not to post, upload, link to or transmit any User Content that:

• Is illegal, violates any law or regulation, or encourages illegal activity.
• Infringes any third party's copyright, trademark, trade secret, privacy or other rights.
• Is defamatory, harassing, threatening, abusive, hateful, obscene, pornographic, or promotes violence/discrimination.
• Contains malware, viruses, spam, scams, phishing or other harmful code.
• Impersonates any person or entity, or misrepresents your affiliation.
• Discloses private information of others without consent.
• Is commercial advertising or spam (except in designated areas).
• Disrupts the Forum or interferes with other users' experience (e.g., flooding, bots).
• Contains sensitive personal data (e.g., financial info, passwords, medical records).
• Promotes or facilitates hacking, cracking, or unauthorized access to systems.

4. Content Moderation & Enforcement

We reserve the right, but have no obligation, to monitor, edit, move, hide or remove any User Content at our sole discretion for any reason, including violations of these Terms. We may suspend or terminate accounts without notice or liability. Moderation decisions are final.

5. User Responsibility & Indemnity

You are solely responsible for your User Content and all consequences of posting it. You agree to indemnify and hold harmless Nirmaan, its operators, administrators, moderators, affiliates and agents from and against all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

• Your User Content, use of the Forum, or interactions with other users.
• Your breach of these Terms or any applicable law or regulation.
• Any claim that your User Content caused harm to a third party.
• Your violation of any third party's rights (copyright, privacy, etc.).

6. Intellectual Property

The Forum design, logos, and software are protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works from the Forum without our written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Nirmaan is provided "AS IS" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

In no event shall Nirmaan or its operators be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, or use, arising from your use of the Forum or reliance on User Content, even if advised of the possibility of such damages.

Our total liability to you shall not exceed INR 1000 (or equivalent in your currency).

8. Third Party Content & Links

The Forum may contain links to third‑party websites or services. We do not endorse or control them and are not responsible for their content, privacy practices, availability, or security. Use them at your own risk.

9. Account Termination & Data

You may close your account at any time through account settings. We may terminate or suspend your access at any time, for any reason, without notice or liability. Upon account deletion, your posts may remain visible but will be anonymized where technically feasible.

10. Acceptable Use Policy

• Do not use automated tools (bots, scrapers) without permission.
• Do not attempt to access unauthorized areas or accounts.
• Do not engage in vote manipulation, brigading, or coordinated abuse.
• Respect rate limits and do not overload our servers.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.

12. Force Majeure

We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, or internet outages.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

14. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Significant changes will be announced on the Forum. Check this page periodically for updates.
